Terms and Conditions for By Mölle slow stays

1. Bookings
By Mölle only accepts bookings from persons aged 18 and over. By Mölle reserves the right to refuse a booking without stating a reason. By Mölle will confirm the booking and issue an invoice by email within one working day of receiving the booking. You must check the confirmation, which also serves as the invoice, for accuracy immediately upon receipt. Any inaccuracies must be reported to By Mölle by telephone or email within ten days of the date of the confirmation and invoice, and in all cases before the start of the stay. If you have not received a written confirmation and invoice within one working day of making the booking, you must contact By Mölle.

Bookings made before 1 September for a stay in the following calendar year may be cancelled by By Mölle no later than 31 August if the accommodation cannot be made available due to serious and unforeseen circumstances. In that event, By Mölle will offer alternative accommodation for the selected period or refund the booking amount already paid in full.

2. Price
The prices listed on www.bymolle.com are not binding. By Mölle reserves the right to change these prices. At the time of booking, you will be informed of the price that applies at that time. The price stated in the confirmation and invoice is binding. Discounts and special offers cannot be applied after the confirmation and invoice have been issued by By Mölle.

3. Tourist tax and other charges
The rental prices include VAT, tourist tax and all other mandatory charges, unless expressly stated otherwise at the time of booking.

4. Payments
The booking amount must be paid within fourteen days of making the reservation.

If the invoiced amount is not paid on time or is not paid in full, you will be in default. By Mölle will send you a payment reminder. If By Mölle has not received the outstanding amount within fourteen days of the date of the reminder, By Mölle is entitled to terminate the agreement unilaterally in writing.

If the agreement is terminated more than ten weeks before the scheduled start date of the stay, you will owe a termination fee of 30% of the booking amount. If the agreement is terminated within ten weeks of the scheduled start date of the stay, you will owe the full booking amount.

Any amounts already paid will be deducted from the termination fee due. If no payment has yet been made, the applicable termination fee will be charged.

5. Changes
If you wish to make changes to the booking after it has been confirmed, By Mölle is not obliged to accept those changes. By Mölle will determine whether and to what extent the requested changes can be accepted.

6. Cancellations
If you cancel more than ten weeks before the start of the stay, 30% of the booking amount will be due. If you cancel within ten weeks of the start of the stay, the full booking amount will be due. If you end the stay early, the full booking amount will remain due.

7. Force majeure
Force majeure on the part of By Mölle exists when performance of the agreement is prevented, in whole or in part, temporarily or permanently, by circumstances beyond the reasonable control of By Mölle. These circumstances include, but are not limited to, the threat of war, staff strikes, blockades, fire, flooding and other disruptions or events beyond the control of By Mölle.

If the stay cannot take place due to force majeure, By Mölle will, where possible, offer an alternative period or alternative accommodation. If no suitable alternative is available, the amount already paid for the part of the stay that cannot be provided will be refunded.

8. Liability
By Mölle is not liable for theft, loss or damage of any kind during or as a result of a stay in one of our accommodations, unless the damage results from a failure attributable to By Mölle.

By Mölle is not liable for technical equipment becoming defective or unavailable, or for facilities at the accommodation becoming unavailable or closing, unless this can be attributed to By Mölle.

The guest and the persons accompanying them are jointly and severally liable for any loss or damage incurred by By Mölle as a direct or indirect result of their stay. This applies regardless of whether the loss or damage is caused by their own acts or omissions or by third parties who are present at the accommodation with their permission. This also applies to damage caused by an animal or item for which they are responsible.

Additional costs, including cleaning costs, may be charged if the accommodation is used incorrectly or is not left in the proper condition.

9. Complaints
Despite the care taken by By Mölle, you may have a justified complaint. You must report the complaint to By Mölle immediately during your stay so that we have the opportunity to resolve it as quickly as possible.

If the complaint is not resolved to your satisfaction, you may submit it to By Mölle in writing or by email no later than one month after leaving the accommodation.

If the complaint cannot be resolved by mutual agreement, the dispute may be submitted to the court that has jurisdiction under the law.
